Mary Maloney should be convicted of second degree murder

  2. First degree murder; second degree murder; or manslaughter? Which one would you believe Mary Maloney should be sent to prison for? Mary Maloney is guilty of second degree murder and nothing else. Patrick Maloney did not commit an illegal act of by speaking his mind and sharing his news with his wife. The Canadian Criminal Code states that manslaughter is "if the person who committed it did so in the heat of passion caused by sudden provocation." (Section 232) Mary may have been provoked, but her choice to kill her husband was not in the heat of passion. She had time to cool off except she decided to try and make things better between Patrick and herself by making dinner. If you plan to kill someone then that takes time which Mary did not have before Patrick came home because she was doing household chores. The criminal Code of Canada is strict about murder charges and "first degree murder [is] when it is planned and deliberate." (Section 231) Even when she found out what Patrick had wanted to tell her, she did not freak out or act crazy or anything. She stayed rather calm and in a state of shock as well. Mrs. Maloney committed a second degree murder. She murdered her husband willingly without hesitation, but she did it in a split second. "When she walked across the room she couldn't feel her feet touching the floor. She couldn't feel anything at all- except slight nausea and a desire to vomit. Everything was automatic now- down the steps to the cellar, the light switch, the deep freeze, the hand inside the cabinet taking hold of the first object it met. She lifted it out, and looked at it. [It was] a leg of lamb. All right then, they would have lamb for supper." (1) Mary had not been provoked by an illegal act nor was it deliberate or planned. It had been a split second decision that she made while her body was still in a state of shock. Therefore, Mary Maloney made the choice to kill her husband, Patrick Maloney, and she should be sentenced to life in prison for committing a second degree murder.

  3. Melanie i totally agree with you for the fact that my only decision was that it was second degree. Yes she did only perform the act of murder on the spot as she was maybe still in shock by her husband telling her of the awful news. personally, i believe that anyone would be mad at the news of their spouse filing a divorce agains them.
