Mary Maloney should be convicted of manslaughter

    Mary Maloney should be convicted of manslaughter of her husband Patrick Maloney. She was provoked by her husband, he did not have the legal right to leave and it was done in the heat of passion.Patrick Maloney provoked Mary by bluntly saying he is going to leave her, at that stage of pregnacy.The criminal code states "Provocation is a wrongful act of insult that is of such a nature as to ... deprive an ordinary person of power of self control"(232). Patrick explains to Mary "There needn'y be any fuss...It wouldn't be good for my job" he then decided to tell her "I'm going out"(1).Patrick Maloney provoked Mary by showing no emotion, but instead just bluntly saying he would leave her , knowing she is 6 months pregnant. He says "it wouldn't be good for my job" showing he cared less about her and more about his reputation, in turn making her lose self control and murdering him since her world revolved around him. Also Patrick did not have the legal right to provoke her without discussing details about his unborn child.Patrick Maloney said"I will give you money and see that your looked after...i'm going out" The law states "[you] need to deal with your spouse concerning any children you have such as custody and child support"Patrick Maloney said he would leave her without talking about the unborn child, as of law he needs to discuss the details about what he will be giving his child, it is unlawful of him to leave Mary pregnant with his child without giving child support or an appropriate divorce.In addition Mary Maloney did the murder in the heat of passion.The criminal code states "[it is] Manslaughter if the person who committed it did so in the heat of passion" (232). Mary whispered
    "I'll supper" when she came back up with the food Patrick then replied "Don't make supper... i'm going out"This made Mary Maloney very angry since she had offered to make supper in after he siad he was going to leave her and now it all became real for her when he said he would leave, this aggravated her , causing her to murder him in the heat of passion. And so Mary Maloney should be convicted her manslaughter because she was illegally provoked, which cause her to murder in the heat of passion.

    1. i disagree with all of you. I believe that she is convicted of second degree murder for the fact that it was not planned, though she decided it at the heat of the moment.

    2. Anonymous is 100% correct! It was not manslaughter, it was second degree murder! Get your facts straight!
